WHAT IS MEDIATION?
Mediation is process used to resolve conflict between two or more people by a professional "Mediator" who acts a 3rd party to assist the individuals to reach an agreement that both sides feels is fair on their own. A Mediator does not make decisions for the parties involved and has no stake in the how the conflict turns out. Everything discussed during the session is kept confidential. The mediator simply listens to both sides and helps them come up with their own solutions to which both sides want to compromise on. The final agreement between them is legally enforceable once both parties have signed. Each side will receive their own copy of the signed agreement. Mediation has grown in popularity over the last 30 years as an alternative to going to court and spending countless hours and dollars using lawyers on both sides.
Mediators can be used for all types of conflicts. Often times a court will mandate that the parties attend mediation. This is common in cases such as divorce, small claims and assault (first time offenders), just to name a few. ?In many cities there are also community mediation centers for non-law related conflicts between neighbors, friends or family members.?
